Charges:
First: For breaking out of Barracks at Newbridge when confined thereto on or about the 2nd May 1863 and for not returning until brought back under escort on or about the 4th May 1863.
Second: For having at or about the period of his absence without leave as stated in the First Charge made away with or lost through neglect the following Articles of his Regimental Necessaries vizt: 1 shirt and 1 pair of Socks.
Third: For conduct to the prejudice of good order and military discipline in having at Newbridge on or about the 5th May 1863, when a Prisoner in the Regimental Orderly Room, made use of insolent and insubordinate language to his C/O Captain C.A.G. Browne, 4th Hussars in saying, `I don't care what you do - try and ___ to you,' or words to that effect.
To the First and Second of which Charges the Prisoner pleaded Guilty.
Opinion: The Court having maturely weighed and considered the evidence in support of the Prosecution together with what the Prisoner has urged in his defence, is of opinion with regard to the First Charge that he, the Prisoner, No. 83 Joseph Moody, Private of the 4th Hussars is Guilty. With regard to the Second Charge, that he, the Prisoner, No. 83 Joseph Moody, Private 4th Hussars is Guilty. With regard to the Third Charge, that he, the Prisoner, No. 83 Joseph Moody, Private 4th Hussars is also Guilty.
Sentence: The Court having found the Prisoner Guilty of all the charges preferred against him, which being in breach of the Articles of War, and taking into consideration his general very Bad Character, his being in the 2nd Class, and his former convictions, does now sentence him, the Prisoner, No. 88 Joseph Moody, Private 4th Hussars to undergo a corporal punishment of fifty lashes, to be imprisoned and kept to Hard Labor for a period of seven hundred and thirty [730] days, to be placed under stoppages in accordance with the 134th Article of War until the Articles specified in the Second Charge, namely 1 shirt and 1 pair of Socks be made good, and further to forfeiture of all advantage or as to additional pay, good conduct pay, and pension on discharge accruing either from past or future service. The Court further recommends that the Prisoner be discharged with Ignominy from Her Majesty's service, and be further marked with the letters BC as prescribed in the 26th Clause of the Mutiny Act.
The Judge Advocate General humbly submitted to Her Majesty to approve and confirm the finding and sentence of the Court.
